Los productos adquiridos mediante este servicio gozan de la misma garantía que los adquiridos directamente en tienda física de DESGUACES OLIVARES, esto es, tratándose de productos de segundo uso, la garantía de los mismos es de un año (exceptuándose consumibles tañes como bombillas, pastillas, de discos, filtros, escobillas, neumáticos, centralitas y material eléctrico)

No obstante, la garantía no cubrirá la mano de obra, defectos, desperfectos ocasionados por el fallo de la pieza, mal montaje o por no seguir las indicaciones de montaje o de mantenimientos indicadas por el fabricante de la misma.

La garantía desplegara su validez siempre que:

• El montaje del recambio se realice en los talleres autorizados*
• No se realice sobre el producto una manipulación indebida, uso inapropiado, negligencia, sobrecarga o abandono de la pieza, así como por inestabilidad de corriente, subidas de tensión, instalaciones o montaje defectuoso, y demás causas externas que no sean imputables a la fabricación y calidad de la pieza
• No se hayan ocasionado al producto daños por roturas, golpes o ralladuras o cuidado negligente
• No se hayan ocasionado en el producto daños por el transporte, por impactos o acciones atmosféricas, o cualquier otra causa de fuerza mayor o que no sea imputable a la calidad de la pieza.
• Se haya procedido a un mantenimiento adecuado del vehículo al que se
ha incorporado la/s pieza/s según las instrucciones de su fabricante.
• Quedan excluidos de esta garantía los daños ocasionados en el transporte no comunicados en un plazo de 24 horas siguientes a su recepción.

Para activar la garantía el cliente deberá mandar un email a [email protected], debiendo indicar sus datos, copia de la factura e indicar el motivo por el que procede la cobertura interesada.

El CLIENTE se hará cargo de la gestión de los portes de la devolución y, una vez constatada la garantía del producto (esto es, no encontrarse en un supuesto de exclusión de los anteriormente referidos), DESGUACES OLIVARES procederá a efectuar el reembolso del importe correspondiente al porte. El cliente/consumidor es quien tiene el derecho de optar entre la reparación o lo sustitución del producto cuyo derecho de garantía ejercita, sin embargo, y de conformidad con las disposiciones legales vigentes, si una de estas posibilidades fuese objetivamente imposible o desproporcionada, no podrá optarse por ella, comunicando DESGUACES OLIVARES la imposibilidad de la opción elegida a la mayor brevedad posible.

Para el ejercicio del derecho de garantía debe tenerse en consideración que los productos suministrados y comercializados por DESGUACES OLIVARES, están debidamente señalados por marcas, precintos y grabaciones propias, para tener una correcta trazabilidad del producto. La rotura de esos precintos invalida la garantía del mismo.

En el caso de motores hay que entender que es imposible conocer con exactitud que operaciones de mantenimiento se han llevado a cabo en dicho motor y si dichas operaciones se han realizado en las condiciones previstas por el fabricante, por lo que es necesario colocar un kit completo de distribución.. Por otro lado en ocasiones es posible que pase bastante tiempo desde que un vehículo entra en nuestras instalaciones, se desmonta y finalmente se vuelve a montar en otro vehículo, por lo que es necesaria la sustitución de la bomba de agua y termostato, así como conservar facturas tanto de los materiales como de las revisiones realizadas en taller indicando fecha, matrícula y kilómetros.

Todos nuestros motores van equipados con un fusible térmico que mide un posible sobrecalentamiento por uso indebido del mismo.

La garantía no cubre accesorios del motor como:

• Motores gasolina. No se responde de accesorios como regleta de inyección, monopunto, etc. Estas piezas se dejan en el bloque para facilitar la combustión pero no entran en el precio ni en la garantía.
• Motores diésel. No se responde de accesorios como turbo, bomba inyectora, inyectores, etc. Estas piezas se dejan en el bloque para facilitar la combustión pero no entran en el precio ni en la garantía.

2º. – GARANTÍA DE TRANSPORTE.

El cliente dispone de un plazo de 24 horas desde la recepción de su pedido para efectuar las reclamaciones por daños sufridos en el producto con ocasión del servicio de transporte prestado.

Para realizar dicha reclamación de daños por transporte, el cliente deberá enviar un correo electrónico a la siguiente dirección, [email protected], en el plazo anteriormente indicado.

Por tanto, la empresa de transporte será la responsable de la mercancía del cliente desde la retirada de la misma en el centro DESGUACES OLIVARES hasta la entrega al cliente en el lugar de destino designado por éste.

3º.- DERECHO DE DESISTIMIENTO Y PLAZO DE DEVOLUCION DE ARTÍCULOS NO DEFECTUOSOS.

El Cliente tendrá derecho a desistir del contrato durante un periodo de 14 días naturales (en adelante “plazo de desistimiento”) sin indicar el motivo desde la fecha de la posesión material del Producto por el Cliente o por un tercero designado por el Cliente distinto del transportista.

En el supuesto de que el Cliente realice un pedido con dos o más Productos y éstos no sean entregados en la misma entrega, el plazo empezará a contar el día que el Cliente, o un tercero designado por el Cliente distinto del transportista, adquiera la posesión material del último de los Productos. Para ejercer el derecho de desistimiento, el Cliente, deberá indicar a DESGUACES OLIVARES, dentro del plazo de desistimiento, su intención de desistir del contrato, cumplimentando y enviando junto con su devolución el modelo de formulario de desistimiento que le facilitaremos previa solicitud a la dirección [email protected].

Asimismo, el Cliente podrá indicar su voluntad de desistir del contrato mediante cualquier tipo de declaración inequívoca en la que manifieste su voluntad de desistir, mediante una carta enviada por correo postal certificado a la siguiente dirección, DESGUACES OLIVARES, Carretera Olivares Villanueva, Km 3 (CP 41804) Olivares (Sevilla), por fax al número 955 990 660 o por correo electrónico [email protected].

Si el Cliente desiste del contrato dentro del plazo de 14 días anteriormente referido, en supuestos de disconformidad sustancial con el producto solicitado, se le reembolsará el importe pagado previa verificación del estado de la mercancía, incluidos los gastos de devolución según lo dispuesto en el apartado a) del artículo 120 RDL 1/2007. Será imprescindible para hacer efectiva la devolución que los productos se encuentren perfectamente embalados. En caso de que los productos resulten dañados debido a un embalaje inapropiado, no se admitirá la devolución. El cliente deberá conservar el justificante de envío de la agencia de transporte encargada de la devolución hasta que, DESGUACES OLIVARES, acuse recibo de la recepción de la mercancía y estado de la misma.

El cliente será responsable de la disminución de valor de los bienes resultante de una manipulación distinta a la necesaria para establecer la naturaleza, las características y el funcionamiento de los bienes. En todo caso, el justificante de compra de los mismos será imprescindible para cualquier devolución.

El reembolso se realizará mediante la entrega al Cliente de una Tarjeta Devolución sin caducidad por la totalidad del importe del producto devuelto, que podrá ser canjeado tanto en el establecimiento físico como a través de la tienda online siempre que hubiera devuelto la mercancía antes del plazo anteriormente indicado; de lo contrario, DESGUACES OLIVARES no hará efectiva la Tarjeta Devolución sin caducidad por la totalidad del importe hasta haber recibido los bienes del cliente. Se considerará cumplido el plazo si efectúa la devolución de los bienes antes de que haya concluido dicho plazo. La entrega de la Tarjeta Devolución sin caducidad se efectuará, una vez verificado el estado de la mercancía, en el plazo máximo de 14 días naturales.
