La fecha de inicio garantía es la de la factura en todo caso.

Nuestra empresa comercializa materiales usados de recuperación procedentes de vehículos fuera de uso a los que, en cumplimiento de la normativa medioambiental vigente, sometemos a un proceso de preparación para la reutilización. Materiales que por su propia naturaleza están sometidos a un determinado nivel de riesgo de fallo, supuesto en el que se le atenderá en garantía, en los términos y condiciones generales contenidos en este texto, sin perjuicio de que normativas especificas puedan ampliar plazos en supuestos concretos, en los que se atenderá dicha normativa.

Nuestra GARANTÍA LIMITADA, consiste en:

La sustitución por otra pieza usada de iguales características que la defectuosa, o la reparación de aquella sin coste para el comprador. La empresa en ningún caso asumirá costes de mano de obra, inmovilizaciones, ni análogos.

La prueba del defecto recae en todo caso en el/la cliente, quien debe de notificarlo a la empresa a la mayor brevedad por escrito al correo electrónico [email protected], aportando la factura de montaje.

Toda reclamación en garantía requerirá que el cliente pruebe que el material ha sido montado diligentemente, por personal cualificado, conforme a las especificaciones del fabricante.

A los materiales electrónicos no se les aplica garantía por la imposibilidad de la empresa de poder probar manipulación posterior por parte del/la cliente, una vez entregada. Son materiales que se venden para su reacondicionamiento por personal especializado, y a un precio acorde a dicho fin.

Sólo se procederá a la devolución del importe efectivo cuando no sea posible la reparación o sustitución de la pieza adquirida. No se hacen devoluciones en efectivo por causa diferente a la imposibilidad de sustituir o reparar una pieza defectuosa. La garantía abarca al objeto que constituye la venta, y no así elementos accesorios que no hayan sido objeto de factura diferenciada y que el desguace ha considerado dejar en el objeto de la venta.

La alteración de los medios de marcaje de los materiales anula toda garantía.

La compra de los materiales se supedita al conocimiento y aceptación de estas condiciones.

Como compromiso voluntario y seguridad a nuestra clientela, de la calidad de nuestros productos, la Empresa destaca que estamos adheridos voluntariamente al Sistema Arbitral de Consumo de Alicante, con código nº 296956, por el cual nuestra clientela tiene un acceso rápido, y gratuito, para la resolución gratuita de cualquier controversia que tenga con nosotros, siendo el laudo resultante de su reclamación, de obligado cumplimiento a la Empresa.

Así mismo y como complemento a nuestra clientela que no gocen de la condición de consumidor al amparo de la normativa al efecto, nuestra empresa voluntariamente les ofrece nuestra predisposición a participar en cualquier tipo de alternativa no judicial para la discusión no litigiosa de controversias, mediación o conciliación, mediante profesionales independientes.

2.- DEVOLUCIONES Solo se admitirán devoluciones previamente aceptadas por la Empresa y dentro del plazo de 14 días hábiles a contar desde la fecha de aceptación/recepción/compra del producto. 3.- CANCELACIONES Además de su derecho a devolución, usted puede cancelar un pedido antes de haberse iniciado la expedición de la mercancía. Comuníquenoslo y su pedido quedará cancelado. Si tiene alguna incidencia, no deje de notificarlo a [email protected].

4.- POLITICA DE ENVIOS El plazo de entrega de nuestros recambios es de 24-48h desde su salida de nuestros almacenes. Para repuestos de más de 50 Kg el plazo se amplía a 72h. Los pedidos de fin de semana o festivos, se tramitarán el siguiente día laborable.

5.- FORO APLICABLE Sin normativa específica al efecto que contradiga este articulado, el foro de competencia para la discusión litigiosa de cualquier controversia dimanante de los términos y condiciones de esta relación comercial, se supedita por acuerdo entre las partes a los juzgados y tribunales de Alicante.

6.- DERECHO DE DESISTIMIENTO ( Sólo para personas físicas que gocen de la condición de consumidor conforme RDL1/2007)Conforme a la normativa vigente relativa a la Defensa del Consumidor y Usuario, la Empresa le informa de su derecho a devolver en el plazo de 14 días naturales, desde la recepción de la mercancía, siempre y cuando se entregue en su propio embalaje original, conteniendo todos los artículos, manuales, accesorios y bonos promocionales cuando los haya, con el comprobante de compra, y libre de cargos a la empresa. No se asumen gastos de transporte tal como se explica en nuestra política de ventas.

7.- DEFENSA CONSUMIDOR Y USUARIO Nuestra Empresa se encuentra voluntariamente adherida al Sistema Arbitral de Consumo de Alicante, con código nº 296956, para la discusión extrajudicial de cualquier controversia con cualquier cliente dentro del ámbito de aplicación de la normativa de defensa de consumidores, en cuya virtud nos obligamos a acatar el laudo arbitral dimanante de cualquier reclamación efectuada.
