GARANTÍA

Todos nuestros recambios están garantizados conforme a la Ley aplicable (Real Decreto Legislativo 1/2007, de 16 de noviembre por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias) El tiempo de garantía será de 1 año, a partir de la fecha de emisión de la factura, únicamente para usuarios o consumidores finales no profesionales, en el caso en que el cliente sea un profesional será de 6 meses al no regirse la transacción comercial por el real decreto y aceptar este pacto como relación contractual. Para la ejecución es imprescindible presentar la factura de compra y haber realizado la sustitución del recambio en un taller debidamente autorizado y realizado el montaje conforme al manual del fabricante.

Es necesario recordarle al comprador, que la carga de la prueba en un procedimiento judicial , recaerá sobre él durante la segunda parte del año de garantía, es decir, los últimos 6 meses. Por lo tanto será este último en este periodo quien deba demostrar que no ha habido un mal uso del bien ( Ley 23/2003, de 10 de julio, de Garantías en la Venta de Bienes de Consumo , Art. 9.1. ) y que se ha producido un deterioro normal del mismo , sin haber incurrido en negligencia previa.

Dentro de la garantía NO se incluye:

Consumibles

(Pastillas y discos de freno, escobillas, neumáticos, inyectores, filtros)

En ningún caso la mano de obra estará incluida.

Causas de anulación de la garantía:

Manipulación indebida del recambio o rotura durante el montaje.

Borrado o manipulación de cualquier marca, precinto o grabación establecida por Desguace Bonaire S.L para la identificación sus recambios.

En el caso específico de que el recambio sea un motor, la no colocación de un kit de distribución, bomba de agua, termostato y sobrecalentamiento del mismo por mal uso. (medido por fusible térmico incorporado al motor)

DERECHO DE DESISTIMIENTO.

Para realizar devoluciones de nuestra tienda On Line y realizadas a distancia habrá un plazo legal de 14 días naturales conforme a la legislación vigente. (Art 44 de la Ley 7/1996, de 15 de enero de Ordenación del Comercio Minorista modificada por la Ley 47/2002 y Art. 71 3/2014 capítulo IV de 27 de marzo de 2014)

Para ejercer el derecho de desistimiento se deberá enviar un mail a [email protected] antes de que venza el plazo, una vez realizado, el cliente deberá enviar el recambio embalado y en las mismas condiciones que lo recibió, asumiendo los costes de la agencia de transporte a excepción de que la devolución fuese motivada por un error imputable a Desguace Bonaire S.L.
