CONDICIONES PARTICULARES Y GARANTÍA DEL RECAMBIO USADO:

DESGUACE CORTÉS S.L. con domicilio social en Ctra. Tavernes de la Valldigna S/N de Benaguacil (Valencia) garantiza como mínimo durante el plazo de SEIS MESES, a contar desde la fecha de la entrega, la conformidad del producto: • La garantía comercial hace referencia a su correcto funcionamiento, teniendo en cuenta su antigüedad y desgaste de las piezas reflejadas en la factura, con exclusión de los conceptos que más abajo se detallan. El plazo para ejercitarla será de UN AÑO, siempre y cuando el comprador tenga consideración de consumidor o usuario final. • Cuando el comprador tenga la naturaleza profesional y no sea consumidor final, el plazo de garantía se extinguirá a los SEIS MESES contados desde la entrega de la pieza vendida (art. 1.490 del Código Civil). El comprador conoce y acepta el estado de desgaste o fatiga que en las piezas usadas puede existir, debido al uso y tiempo de funcionamiento de la pieza.

DESGUACE CORTÉS S.L. se obliga durante el periodo de garantía a reparar la pieza deteriorada. Será facultad del vendedor optar por la reparación o la sustitución de la pieza por otra de sus mismas características. Si la reparación no es posible o es desproporcionada y el vendedor no puede ofrecer la sustitución, el comprador podrá optar por una rebaja adecuada en el precio o por la resolución del contrato con devolución del precio. Todo ello de conformidad con el Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias. La garantía no cubrirá aquellos gastos de estancia en taller o alojamiento, desplazamientos, ni aquellos gastos consecuencia de encontrarse el vehículo parado. Sí cubrirá los portes de transporte (de vuelta), siempre y cuando se haya comprobado cerciorado que, dicho recambio está en garantía. En cualquier caso, para proceder a la comprobación de la garantía, será requisito imprescindible, la exhibición de la factura o en su defecto, del pedido de compra de la pieza. Para ello, deberán enviar un correo electrónico a [email protected] adjuntando copia de la factura y/o pedido de compra.

LA GARANTÍA NO CUBRE:

a. Manipulación indebida, uso inapropiado, negligencia, sobrecarga, abandono, inestabilidad de corriente, subidas de tensión, instalaciones o montajes defectuosos, y demás causas externas que no sean imputables a la fabricación y/o calidad de la pieza. b. Daños ocasionados por roturas, golpes o ralladuras, o cuidado negligente. c. Daños causados por el transporte, por impacto o acciones atmosféricas, o cualquier otra causa de fuerza mayor que no sea imputable a la calidad de la pieza. d. Las reparaciones y/o instalación de las piezas efectuadas por personal no cualificado. e. Las reparaciones, manipulaciones y/o instalaciones efectuadas después de manifestada alguna disconformidad por el comprador y sin autorización expresa por escrito de DESGUACE CORTÉS S.L. f. Las reparaciones, manipulaciones y/o instalaciones realizadas por existir algún defecto de origen y sin que previamente se haya manifestado por escrito la disconformidad del comprador. g. La falta de mantenimiento del vehículo al que se ha incorporado la pieza, o bien que el mismo se ha efectuado de forma incorrecta e inadecuada según las instrucciones de su fabricante o lo que se considera como la práctica habitual en función de las características concretas del vehículo o motor. Así, como la incorrecta utilización del vehículo que determine la avería de la pieza, todo ello después de instalada la misma. h. Los accesorios incorporados a la pieza vendida que consten en la factura de venta como “sin cargo al precio final”. i. Cuando el producto sea vendido como motor, éste estará compuesto por la culata, el bloque y el cárter, así como sus piezas interiores de funcionamiento, quedando excluidas de la garantía las piezas accesorias unidas al motor, como pueden ser, la bomba inyectora, el turbo y las piezas exteriores que vayan montadas en el motor, el cuerpo inyector, inyectores, calentadores, bujías, correas, manguitos distribuidor y bobinas de encendido, bomba de agua, colectores de admisión y de escape, diferentes radiadores, depresor, ventilador, diferentes sensores e instalaciones eléctricas o cualquier otra pieza no enumeradas y que no sea considerada un inherente al motor. j. En cuanto a la distribución, para la efectividad de la garantía es necesario acreditar el cambio de la correa de distribución en los motores, en caso contrario la garantía queda invalidada. k. El calentamiento, sobrecalentamiento del motor por causas ajenas a este o por incorrecto o defectuoso montaje. l. El uso inadecuado de aceites, su omisión al instalar el motor, o incorrecto cebado del mismo. m. Atendiendo a su naturaleza, y tratándose de piezas de segunda mano, en ningún caso se garantizarán las piezas accesorias como retenes, filtros o termostatos. n. LA MANO DE OBRA QUEDA EXCLUIDA DE LA GARANTÍA EN TODOS LOS CASOS.
