GARANTÍA

El presente documento describe las condiciones generales de compra en DESGUACE LA CARAVANA SL, que son de aplicación para todas las operaciones de compraventa de los productos ofrecidos en la web y cuya transacción se realice a través de la misma.

Nuestros recambios están garantizados conforme a la Ley aplicable (Real Decreto Legislativo 1/2007, de 16 de noviembre por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias).

Es necesario recordarle al comprador, que la carga de la prueba en un procedimiento judicial, recaerá sobre él durante la segunda parte del año de garantía, es decir, los últimos 6 meses. Por lo tanto, será este último en este periodo quien deba demostrar que no ha habido un mal uso del bien (Ley 23/2003, de 10 de julio, de Garantías en la Venta de Bienes de Consumo, Art. 9.1.) y que se ha producido un deterioro normal del mismo, sin haber incurrido en negligencia previa.

Para ejecutar cualquier garantía, es necesario que el montaje se realice por personal cualificado en talleres autorizados, cumpliendo las instrucciones y especificación del fabricante del vehículo, lo que deberá ser acreditado mediante factura.

Los artículos comercializados por Desguace La Caravana están debidamente señalados por sellos, marcas, precintos y grabaciones propias, para tener una correcta trazabilidad del producto, la rotura de estos precintos invalida la garantía del mismo.

EXCEPCIONES Y ACLARACIONES DE GARANTÍA

La garantía no comprende los defectos de las piezas que se produzcan por:

Manipulación indebida, uso inapropiado, negligencia, sobrecarga o abandono de la pieza, así como por inestabilidad de corriente, subidas de tensión, instalaciones o montaje defectuoso, y demás causas externas que no sean imputables a la fabricación y calidad de la pieza.

Daños ocasionados por roturas, golpes o ralladuras o cuidado negligente.

Daños causados por el transporte, no comunicados en un plazo inferior a 24H desde la recepción del mismo.

Las reparaciones y/o instalaciones de las piezas efectuadas por personal no cualificado.

Rotura de precintos.

La falta de mantenimiento del vehículo al que se ha incorporado las piezas, o bien que dicho mantenimiento se haya efectuado de forma incorrecta e inadecuada según las instrucciones de su fabricante.

MOTORES:

Hacemos referencia como “motor completo” a la parte principal del motor comprendida por culata y bloque y sus piezas interiores de funcionamiento. Quedan excluidas las piezas exteriores que vayan montadas en el motor como por ejemplo bomba inyectora, inyectores, calentadores, bujías, correas, manguitos, distribuidor y bobinas de encendido, bomba de agua, termostato, volante de motor, embrague, turbocompresor, colectores de admisión y de escape, diferentes radiadores, depresor, ventilador, diferentes sensores e instalaciones eléctricas o cualquier otra pieza no enumerada anteriormente que no haya sido objeto de venta diferenciada y facturada, considerándose el resto como material donado. Estos materiales, anteriormente referenciados que pudieran ir montados junto al motor, tienen la consideración de accesorios y se aconseja al cliente sustituirlos por los suyos.

Para la correcta efectividad de la garantía es necesario acreditar el cambio de la correa de distribución, tensores y rodamientos. En caso contrario la garantía queda invalidada.

En caso de ser por cadena se tendrá que sustituir la misma, patines y tensores.

Por otro lado, en ocasiones es posible que pase bastante tiempo desde que el vehículo entra en nuestras instalaciones, se desmonta y finalmente se vuelve a montar en otro vehículo similar por lo que es necesario sustituir bomba de agua y termostato.

El calentamiento o sobrecalentamiento del motor por causas ajenas a éste.

El uso inadecuado de aceites.

La mano de obra queda absolutamente excluida de la garantía en todos los casos, asi como lubricantes o accesorios utilizados en la sustitución de los mismos.

CAJAS DE CAMBIOS

Las cajas de cambio se entregan sin valvulina, cualquier componente o elemento que no esté especificado en la factura de venta carece de todo tipo de garantía. Para que la garantía sea efectiva es necesario que sea montada en un taller mecánico autorizado y legalizado, además es necesario el cambio del collarín de embrague y los retenes de las transmisiones.

DERECHO DE DESISTIMIENTO.

Desguace La Caravana ofrece un período de devolución de 14 días según normativa legal vigente. Para ejercer el derecho de desistimiento se deberá enviar un mail a [email protected] antes de que venza el plazo. Una vez realizado, el cliente deberá enviar el recambio embalado en su embalaje original, protegido y en las mismas condiciones que lo recibió, asumiendo los costes de la agencia de transporte (envío y retorno). En caso contrario nos reservamos el derecho de rechazar la devolución.

Según la Ley 47/2002 de Ordenación del Comercio Minorista, consumibles que hayan sido desprecintados productos que se hayan probado o usado y que ya no puedan venderse (piezas electrónicas como centralitas, abs, etc.), productos que vayan con embalaje tipo «blíster», no podrá aceptarse nunca la devolución una vez que el producto haya sido abierto.

El abono del recambio se realizará como máximo a los treinta dias posteriores a la recepción del producto en nuestras instalaciones ya que debe seguir un proceso de inspección y verificación.

PRODUCTO INCORRECTO

En caso de que el comprador recibiera un producto que no se ajusta con la compra realizada, DESGUACE LA CARAVANA, S.L. procederá a su oportuna devolución sin coste para el comprador. En este caso, el comprador deberá enviar el producto en su embalaje original. Una vez haya sido recibido, se verificará que el producto se corresponde con el albarán de devolución y que este ha sido recibido en perfectas condiciones de uso, completo, en su embalaje original y sin indicios de haber sido usados. Si la comprobación fuera correcta, DESGUACE LA CARAVANA, S.L. enviará al comprador la pieza solicitada sin ningún cargo para el comprador, salvo que no estuviera en stock, en cuyo caso procedería a reintegrar el importe de la compra en un plazo máximo de treinta días.
